Terms of Use

These terms govern your use of Tracey’s drawing references, lessons, camera-assisted tracing and optional paid features.

1. Tracey’s service

Tracey offers drawing references, teaching lessons, image-simplification tools and camera-assisted guides for educational and recreational use. Results depend on your device, environment and practice. Tracey does not promise a particular artistic result.

2. Age and permission

You must be at least 13 to use Tracey. If you have not reached the age of legal majority where you live, your parent or guardian must review and agree to these terms. Where local law requires parental authorization for consent-based processing, including for users under 16 in Germany, your parent or guardian must provide that authorization.

3. Safe and responsible use

Use a stable phone stand and a safe, well-lit workspace. Do not hold or balance a phone unsafely while drawing. You are responsible for your surroundings, equipment and compliance with applicable law.

You must not misuse, disrupt or overload Tracey; bypass access controls; automate excessive requests; introduce malicious code; or use the service to violate intellectual-property, privacy, publicity or other rights. Legal rights to inspect or reverse engineer software are not restricted where they cannot lawfully be excluded.

4. Your images and artwork

You keep ownership of images and drawings that you create or provide. You give Tracey only the limited permission needed to process your selected content on your device and carry out features you request. User-provided images are not automatically added to the public library.

You are responsible for having the rights needed to use an uploaded image. Do not use Tracey to infringe copyright, privacy, publicity or trademark rights. Sharing an output outside private drawing practice may require additional permission from the relevant rights holder.

5. Tracey and library content

The app, branding, original references, lesson text and software are owned by or licensed to the provider. We give you a personal, limited, non-exclusive, non-transferable right to use Tracey for its intended purpose while these terms apply.

Built-in search is designed to return records marked by their source as Public Domain or CC0 and show available attribution information. Source metadata may be incomplete or incorrect. Check the linked source before commercial, promotional or other public reuse.

6. Tracey Pro and subscriptions

• Products, billing periods, prices and any introductory offer are displayed by Apple before purchase.
• Payment is charged to your Apple Account. Auto-renewable subscriptions continue unless cancelled through Apple at least 24 hours before the current period ends, subject to Apple’s displayed terms.
• You can manage or cancel a subscription in your Apple Account settings and restore eligible purchases from Tracey.
• Refund requests are handled by Apple, without limiting mandatory consumer rights.
• We may change future pricing or included features with notice and any consent required by Apple or applicable law. Features already purchased remain subject to mandatory consumer protections.

7. Availability and updates

We may improve, replace or discontinue features. Online search depends on third-party services and may be temporarily unavailable. We do not guarantee uninterrupted or error-free operation, but we do not exclude obligations that cannot legally be excluded.

8. Ending use

You may stop using Tracey at any time. We may restrict access where reasonably necessary to address unlawful use, security risks or a serious breach of these terms. Subscription cancellation and app deletion are separate: deleting the app does not automatically cancel an Apple subscription.

9. Responsibility and consumer rights

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable consumer guarantees in Australia, statutory rights in the UK and Germany/EU, and applicable US consumer protections. Subject to those rights, Tracey is provided for personal educational and recreational use, and neither party is responsible for losses that were not reasonably foreseeable when you accepted these terms.

These terms are governed by the laws of Cyprus, while preserving any mandatory protections and courts available to consumers in their country of residence.

10. Apple terms

When downloaded from Apple’s App Store, Apple’s applicable usage rules and Standard Licensed Application End User License Agreement also apply. Apple is not responsible for Tracey support; contact us using the details below.

11. Changes and contact

We may update these terms for legal, security or product reasons. If a change materially affects existing rights, we will provide notice where required. The current version and effective date will remain available here.
